RETURN & EXCHANGE POLICY
Terms and Conditions & Return Policy Sun & Wave Beach Rentals LLC
Effective Date: March 1, 2023
Please read these Terms and Conditions and Return Policy carefully before renting or purchasing any equipment from Sun & Wave Beach Rentals LLC (“Company,” “we,” “us,” or “our”). By placing an order or accepting delivery, you (“Customer,” “you,” or “your”) agree to be bound by these terms.
1. General Terms and Conditions

Orders and Acceptance: All orders and rentals are subject to acceptance by the Company. We reserve the right to refuse or cancel any order/rental for any reason.

Pricing and Payment: Prices are subject to change without notice. Full payment is required at the time of booking/order unless a deposit agreement is made in writing.

Delivery / Pickup: Delivery times are estimates only. Risk of loss or damage passes to the Customer upon delivery to the designated address. Title remains with Sun & Wave Beach Rentals LLC for all rental equipment.

Customer Responsibilities After Delivery: Once the equipment has been delivered, the Customer is fully responsible for the equipment. This includes proper storage, use, maintenance, security, and protection from damage, theft, loss, or misuse until the equipment is picked up by the Company or its authorized agent. The Company is not liable for any issues that occur after delivery.

Use of Equipment: Equipment must be used only for its intended purpose in accordance with manufacturer guidelines. Misuse voids all warranties and releases the Company from liability.

Warranties: Equipment carries only manufacturer warranties (if any). The Company provides no additional warranties unless explicitly stated in writing.

Limitation of Liability: To the maximum extent permitted by law, Sun & Wave Beach Rentals LLC shall not be liable for indirect, incidental, consequential, or punitive damages. Our total liability shall not exceed the amount paid by the Customer.

Governing Law: These terms are governed by the laws of the State of Florida. Any disputes shall be resolved exclusively in the courts of Brevard County, Florida.
2. Return / Cancellation Policy

No Refunds After Delivery: Once equipment has been delivered, we cannot accept returns or issue refunds for any reason, including change of mind, weather conditions, or unused equipment. All rentals and sales are final upon delivery.

Pre-Delivery Cancellations: Cancellations made before delivery/shipment may be approved at our discretion and may incur a cancellation fee of up to 50% plus any incurred costs.

Defective or Damaged Equipment: You must report any damage or defects within 24 hours of delivery with clear photos and documentation. We will, at our sole discretion, repair, replace, or issue a partial credit. Claims after 24 hours will be denied.

Customer Responsibility Until Pickup: The Customer remains fully responsible for the equipment’s condition, security, and care from the time of delivery until it is physically picked up by Sun & Wave Beach Rentals LLC. Any loss or damage during this period is the Customer’s financial responsibility.

Non-Returnable Items: Used, installed, modified, or opened equipment is never returnable.
3. Additional Provisions

Force Majeure: We are not responsible for delays or failures due to events beyond our control (weather, hurricanes, supply issues, etc.).

Entire Agreement: These terms constitute the full agreement between the parties.

Changes: We may update these terms. Continued business with us after changes means you accept the new terms.
